A meeting of the Commissioners of Public Utility District No. 1 of Clark County was held at 1200 Fort Vancouver Way on Tuesday, July 21, 2026.

At 9:00 a.m., Vice President Erickson called the meeting to order for the transaction of formal business and the agenda was approved as presented (Materials B).

Public Comment
Don Steinke provided comment on the Electric Vehicle Charging project at Columbia Shores, battery storage and grid utilization.

Cathryn Chudy provided comment on Nuclear Regulatory Commission updates to radiation risk and regulations.

Jonathan David provided comment on his desire for Clark Public Utilities to offer more demand response programs.

Consideration of the Minutes of July 6, 2026 and July 7, 2026
The minutes were approved as submitted.

Consideration of Accounts Payable
The board, by unanimous vote, approved the following payment amounts as listed on the Letter of Transmittal dated July 21, 2026 from the District Auditor (Materials C):

Electric Revenue Fund – $24,611,793.57
Water Revenue Fund – $944,491.11
Generating System Fund – $656,978.48

For a total of $26,213,263.16

Consideration of Resolutions for the Electric Systems Revenue and Refunding Bonds 2026, Generating System Revenue and Refunding Bonds 2026 and the Generating System Master Revenue Bond
Director of Finance Melissa Ankney reviewed the project team, financing schedule and the estimated refunding savings for the Electric and Generating Systems (Materials D). Ms. Ankney shared the series 2026 bond sources, uses and key financing statistics for each of the bonds.

Commissioner Van Dyke moved to adopt Resolution No. 7958 providing for the sale, issuance and delivery of the District’s Electric System Revenue and Refunding Bonds, 2026, in the principal amount of not to exceed $150,000,000. The resolution delegates the authority to the General Manager or the Director of Finance to sign the bond purchase agreement. Commissioner Barnes seconded the motion and it unanimously passed.

Commissioner Barnes moved to adopt Resolution No. 7959 providing for the sale, issuance and delivery of the District’s Generating System Revenue and Refunding Bonds, 2026, in the principal amount of not to exceed $40,000,000. The resolution delegates the authority to the General Manager or the Director of Finance to sign the bond purchase agreement. Commissioner Van Dyke seconded the motion and it unanimously passed.

Commissioner Van Dyke moved to adopt Resolution No. 7960 providing for the Generating System Master Revenue Bond Resolution, Commissioner Barnes seconded the motion and it unanimously passed.

Consideration of Resolutions of Intent to Establish LUD Nos. 1496 and 1514
Director of Engineering Ryan Kerr addressed the board regarding the Intent to Establish Local Utility District Nos. 1506, 1507 and 1516.

Resolution No. 7964 – LUD No. 1506 – Hidden Pine Subdivision
Resolution No. 7965 – LUD No. 1507 – 119th St. Station
Resolution No. 7966 – LUD No. 1516 – Sturgeon Run

After the presentation by Mr. Kerr, Commissioner Erickson opened for public comment. There being no comment, a motion was made by Commissioner Barnes, seconded by Commissioner Erickson and unanimously carried that Resolution Nos. 7964 – 7966 be adopted and a public hearing was set for August 11, 2026 (Materials E).

Bonneville Power Administration Provider of Choice Contract
Director of Energy Resources Steve Andersen reviewed the timeline for the Above-Contract High Water Mark (CHWM) elections. Election A: All BPA Long-Term Tier 2 Rate, Election B: Fixed amount served at BPA Long-Term Tier 2 Rate plus Flexible above-CHWM path for the remainder, Election C: Fixed amount of Flexible above-CHWM path plus BPA Long-Term Tier 2 Rates for the remainder. Election D includes four options: BPA Short-Term Tier 2 Rate, BPA FPS Sale, BPA Vintage Resource Tier 2 Rate, and Non-Federal Market and Physical Resources up to Above-CHWM Amount. Clark is only eligible to select C or D.

After a review of all options and taking into consideration the Combine Hills Wind Project, Projected 2029* Resource Costs, the more expensive cost of renewable power purchase agreements and the Energy Independence Act requirements staff recommended election C.

After board discussion and public comment, Commissioner Barnes moved to authorize the Director of Energy Resources Steve Andersen to inform the Bonneville Power Administration of Clark Public Utilities’ selection of Above-CHWM Election C with a flexible Above-CHWM path fixed amount of 94 aMW with any Above-CHWM load above the fixed amount to be served at the BPA Long-Term Tier 2 Rate. Commissioner Erickson seconded the motion and it unanimously passed.

Commissioner Reports and Comments
Commissioner Barnes reported on her attendance at the Washington PUD Association meetings and the Public Power Council FUEL meeting.

Commissioner Erickson reported on her attendance at the Hazel Dell/Salmon Creek Business Association Meeting, Pacific Northwest Utilities Conference Committee, the Employee Appreciation Events, the Washington PUD Association Board of Directors meeting and a tour of the Port of Camas/Washougal properties.

Staff Reports
CEO/General Manager Lena Wittler thanked staff for all the behind the scenes work on the bonds and the CHWM election.
